In this case, petitioners are seeking bail in connection with Jalalgarh P.S. Case No. 139 of 2015 registered for offences under sections 147, 148, 149, 323, 307, 302 and 504 of the Indian Penal Code.
Altogether 22 accused persons formed unlawful assembly and when the informant and his brother entered into the temple premises, the accused persons mercilessly assaulted them who also made a prayer for leaving them, but they continued to assault. The brother of the informant, Chandeshwari Mandal,
Patna High Court Cr.Misc. No.39495 of 2016 (2) dt.17-09-2016 2/2 succumbed to injury, died in I.G.I.M.S., Patna. The cause of dispute has been shown that the marriage of informant's niece (Bhagni), Nutan Devi was solemnized with one Vinay Mandal and she was tortured by her in-laws and on account of protest by the informant, the accused persons made conspiracy and tried to kill her.
No specific allegation has been made against the petitioners.
In such view of the matter, let the petitioners, above named, be released on bail on or after 17th October 2016 on their furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-V, Purnea in connection with Jalalgarh P.S. Case No. 139 of 2015.
