JUSTICE SANJAY PRIYA ORAL ORDER 21-06-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Chanan P.S. Case No. 15 of 2012 instituted for the offence under Sections 25(1-b)a, 26 and 35 of the Arms Act.
It has been submitted on behalf of the petitioner that petitioner is in custody since 11.7.2016.
A report has been received from the In charge, Sessions Judge, Lakhisarai, kept at Flag-B, stating therein that out of seven charge sheet named witnesses, three witnesses including the informant have been examined.
In such circumstances, since the trial has begun and three witnesses including the informant have already been examined, prayer for bail of the petitioner stands rejected at this
Patna High Court Cr.Misc. No.7195 of 2017 (5) dt.21-06-2017 2/2 stage.
The court below is directed to expedite the trial by giving short adjournment and will make effort to conclude the trial within six months from the date of receipt of this order. In the event the court below fails to conclude the trial within six months, it will send report to this Court with reason as to why the trial has not been concluded within time.
The petitioner is given liberty to renew his prayer for bail in the event the trial is not concluded within six months in the court below itself.
