JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-07-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is apprehending his arrest in a case registered under Section 153, 174C and 147 of Railway Act, in connection with Fatuha R.P.F. Case No. 361 of 2019. Allegation against the petitioner and others is that they deliberately put aluminium paper meant for packing food over the signal as a result of which, green signal became red and the driver had to stop the train by using emergency brake and thereby the accused persons caused threat to life of the passengers as well as the property.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and has nothing to do with the allegation and he is ready to abide by any terms
Patna High Court CR. MISC. No.41563 of 2019(2) dt.05-07-2019 2/2 and condition for grant of anticipatory bail. Having heard both sides, considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt / production of a copy of this order be released on bail on furnishing bail bonds of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Rail, Patna, in connection with Fatuha R.P.F. Case No. 361 of 2019 subject to the condition as mentioned under Section 438 (2) Cr.P.C.
