JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 489B, 489C/34 of the Indian Penal Code.
Earlier the prayer for bail of the petitioner was rejected by this court vide order dated 29.03.2016 passed in Cr. Misc. No. 12271 of 2016 taking note of recovery of counterfeit notes from possession of the petitioner but again the bail of the petitioner is sought on the ground that having more or less similar allegation, co-accused, Kamlesh Kumar @ Kamlesh Kumar Yadav, Manish Kumar Singh and Abdul Rahman have already been granted privilege of bail by different Benches of this Court.
Patna High Court Cr.Misc. No.47857 of 2016 (3) dt.07-12-2016 2/2 Learned counsel appearing for the petitioner submits that petitioner is in jail custody for more than one year and does not have any criminal antecedent. It is also pointed out that according to prosecution case, Rs. 50,000/- counterfeit notes were recovered from possession of co-accused, Kamlesh Kumar @ Kamlesh Kumar Yadav and the aforesaid co-accused, Kamlesh Kumar @ Kamlesh Kumar Yadav has been released on bail. It is further submitted that case of petitioner is on better footing to that of co-accused, Kamlesh Kumar @ Kamlesh Kumar Yadav and some others.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II, Patna in connection with Sessions Trial No. 313 of 2016 arising out of ATS (Bihar) P.S. Case No. 03 of 2015, subject to condition that one of the sureties must be close relative of the petitioner and holder of landed property. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
