KUMAR ORAL ORDER 17-09-2018 Heard learned counsel for the petitioner learned counsel for the informant and learned A.P.P. for the State. The petitioner seeks bail in Chapra Muffasil P.S. Case No. 77/2018, registered for the offences punishable under Sections 302, 307 and 34 of the Indian Penal Code and section 27 of the Arms Act.

The informant alleged that on 19.02.2018, he got information that his crops were destroyed by the petitioner and others. The informant along with others went there and asked the reason for destroying the crops. Allegation against petitioner is attempt to assault informant by iron rod.

Petitioner has falsely been implicated in the case. Petitioner has no criminal antecedent. He is in custody since

Patna High Court Cr.Misc. No.40078 of 2018 (4) dt.17-09-2018 2/2 21.02.2018.

Learned A.P.P. however, vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate XI, Saran at Chapra in connection with Chapra Muffasil P.S. Case No. 77/2018.
