2. The petitioner seeks regular bail in connection with Chorout P.S. Case No. 83 of 2023 registered for the offence under Sections 363, 366(A) and 34 of the Indian Penal Code and under Section 8 of the POCSO Act.

3. Though the allegation against the petitioner is of kidnapping the victim girl but from the case diary it appears that the victim and the petitioner went and presented themselves before the Police.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. The

Patna High Court CR. MISC. No.39093 of 2025(2) dt.25-06-2025 2/2 petitioner is in custody since 20.04.2025. He further submits that the petitioner and the victim had eloped.

5. Learned A.P.P. appearing for the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned concerned Court below, Sitamarhi in connection with Chorout P.S. Case No. 83 of 2023.
