2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 309 (4) BNS.
3. The case of the prosecution is that unknown miscreants have intercepted the informant while he was returning home after closing his shop and it is alleged that on gunpoint he was robbed of Rs. Fifteen hundred, helmet and a silver Kada.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Learned counsel for the petitioner has further been submitted that the FIR was lodged
Patna High Court CR. MISC. No.40204 of 2026(2) dt.23-06-2026 2/2 against unknown miscreants. During course of investigation, the petitioner was apprehended from the car. He has further submitted that the car does not belong to him and that nothing has been recovered from the possession of the petitioner. It has further been submitted that similarly situated co-accused Ashish Kumar has been granted bail by learned coordinate Bench of this court vide Cr. Misc. No. 38191 of 2026. Petitioner is having one criminal antecedent. Moreover, he is languishing in judicial custody since 31.12.2025.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Supaul P.S. Case No. 648 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M, Supaul.
