2. The petitioners who apprehend arrest in connection with Madhepura (Parmanandpur) P.S. Case No. 1438 of 2024 lodged on 20.12.2024, for the offences punishable under sections 126(2), 115(2), 118(1), 303(2), 109, 351(2), 76, 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3.As per the prosecution, the F.I.R. has been lodged against four accused persons, including the petitioners, alleging

4. Learned counsel for the petitioners submits that the petitioners are innocent and have not committed any offence. Their antecedents are clean. It is further submitted that the informant and the petitioners are agnates, and there exists a land dispute between the parties. A case and counter-case have been lodged arising out of the same date and place of occurrence. Petitioner No.1 has instituted Madhepura P.S. Case No. 1437 of 2024 against the informant and his family members, while the informant has filed the present case, bearing Madhepura (Parmanandpur) P.S. Case No. 1438 of 2024.
5. Learned APP for the State opposes the prayer for bail but fairly submits that there case and counter case between the parties.
6. In the aforesaid facts and circumstances of the case, let the above-named petitioners be released on bail, in the event of their arrest or surrender before the Trial Court within a period of four weeks from today, on furnishing bail bond of 30,000/- ₹ (Rupees Thirty Thousand only) each, as mentioned in Section 2(1)(d) of the Bharatiya Nagrik Suraksha Sanhita, 2023, to the satisfaction of the learned CJM, Madhepura, in connection with Madhepura (Parmanandpur) P.S. Case No. 1438 of 2024, subject
Patna High Court CR. MISC. No.38999 of 2025(2) dt.25-06-2025 3/3 to the conditions as laid down under Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023.
