JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 10-03-2016 By way of the present application preferred under Article 226 of the Constitution of India, the petitioner prays for quashing of the first information report of Patori P.S. Case No.98 of 2015 registered under section 135 of the Electricity Act, 2003. Referring to the counter affidavit filed on behalf of the respondent no.1, learned counsel for the State has submitted that on completion of investigation, the police have already submitted
Patna High Court Cr. WJC No.795 of 2015 (3) dt.10-03-2016 2/2 charge-sheet against the petitioner vide charge-sheet no.406 of 2015 dated 31.12.2015.
In view of the subsequent development which took place during the pendency of the present application, learned counsel for the petitioner seeks leave to withdraw the present application with liberty to challenge any adverse order which the court may have passed or may pass on perusal of the police report submitted under section 173(2) of the Code of Criminal Procedure. Leave is granted.
