JUSTICE BIRENDRA KUMAR ORAL ORDER 07-12-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 363 and 366/34 of the Indian Penal Code.

The FIR was lodged on missing of minor daughter of the informant.

Submission is that the daughter of the informant had love affairs with co-accused, namely, Indrajeet Kumar @ Amarjeet Kumar @ Indrajeet Rai who has already been granted regular bail by this Court in Cr. Misc. No. 35938 of 2016. Some other co-accused have also been allowed anticipatory bail as there was material produced regarding court marriage and marriage in the temple by the daughter of the informant with Indrajeet. Subsequently

Patna High Court Cr.Misc. No.52568 of 2016 (2) dt.07-12-2016 the girl resiled from her stand of love affairs. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Patna/Successor Court in connection with Shastri Nagar Police Station Case No. 68 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
