JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 25-05-2015 The petitioner apprehends arrest in relation to Complaint Case No. 4062 of 2013 of which cognizance has been taken under sections 323 and 354 of the Indian Penal Code. Learned counsel for the petitioner points out that the petitioner and the complainant are in neighbourhood and out of petty dispute that this complaint has been filed. There is already a proceeding under section 107 of the Code of Criminal Procedure as between the parties which, in fact, was instituted on the day when the complaint was filed.
Be that as it may, in the event of arrest or surrender of the petitioner within four weeks from today, the petitioner above named shall be released on bail on furnishing
Patna High Court Cr.Misc. No.45909 of 2014 (3) dt.25-05-2015 bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Noor Sultana, Judicial Magistrate, 1st Class, Vaishali at Hajipur in connection with Complaint Case No. 4062 of 2013 subject to all the conditions as laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
