06-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner, in the present case, is seeking regular bail in connection with Kamtaul P.S. Case No. 137 of 2016 registered for the offence punishable under Sections 401, 402, 420, 467, 468, 414 and 216(A) of the Indian Penal Code.

Learned counsel for the petitioner refers the First Information Report and submits that the F.I.R. has been lodged by the Officer-in-Charge of the Kamtaul Police Station on the basis of secret information said to have been received by him that about 4 to 5 persons have come from outside in the house of Santu Paswan and they are planning to commit offence. It is alleged that on the

raid conducted by the police party, Sanjit Paswan was arrested and disclosed the name of other accused persons namely, Mukesh Paswan @ Disco and Pintu Singh (petitioner). Learned counsel for the petitioner submits that the petitioner is known as Barun Kumar Singh, he has enclosed copy of the Aadhar Card in proof thereof as Annexure-2.

Learned counsel for the petitioner submits that name of the petitioner has been brought on suspicion without there being any basis, the petitioner is having clean antecedent and co-accused Santu Paswan and Sanjit Paswan have been granted regular bail by a coordinate Bench of this Court in Cr. Misc. No. 50523/2016 and Cr. Misc. No. 54961/2016.

Learned A.P.P. for the State opposes the prayer for bail.

Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga, in connection with

Kamtaul P.S. Case No. 137 of 2016, subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure.
