====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 19-12-2018 Heard learned counsels for the petitioner and the State.

Petitioner seeks bail in connection with Warsaliganj P.S. Case No. 182 of 2016 registered for the offence punishable under sections 364, 365, 302, 201 and 120-B of the Indian Penal Code.

Petitioner has earlier moved this court twice in Criminal Misc. Nos. 53105 of 2016 and 55626 of 2017 which were rejected vide orders dated 15.02.2017 and 29.11.2017 respectively (Annexure-1 Series). In the last order, the trial court was directed to expedite the trial of the case and conclude it expeditiously preferably within a period of six months. On the submission of the learned counsel for the petitioner that there is no progress in the trial, this court vide order dated 31.10.2018 had called for the report from the court

Patna High Court Cr.Misc. No.43198 of 2018(5) dt.19-12-2018 2/2 below regarding the stage of the trial which has been received and kept at flag 'B'. Perusal of the report shows that there is no substantial progress in the trial.

Considering the facts and circumstances of the case, the fact that there is no substantial progress in the trial and period of the custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-V, Nawada in connection with Session Trial No. 589/2016/744/16.
