Petitioner, who is in custody, seeks bail in connection with Sahebganj P.S. Case No. 26 of 2018 registered for the offences punishable under Sections 304(B), 201 and 34 of the Indian Penal Code.
Informant, who is uncle of the deceased, has stated in his written report that his niece Babita Kumari married with Subhash Bhagat, son of petitioner, three years ago. On 29.01.2018 he got information that his niece has been killed by her husband and parents due to non-fulfillment of demand of motorcycle as dowry and her dead body was concealed. It has been submitted that petitioner is innocent and has been falsely implicated in this case. Petitioner is father-in-
Patna High Court Cr.Misc. No.40767 of 2018(3) dt.10-09-2018 2/2 law of the deceased and he is living separately. The petitioner is about 70 years old person. He is in custody since 31.01.2018 and he has no criminal antecedent.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge 1st -cum- A.C.J.M., 1st Muzaffarpur in connection with Sahebganj P.S. Case No. 26 of 2018. The bail bond of petitioner will be accepted by the learned court below after surrender of husband of the deceased.
