ANJANA MISHRA ORAL ORDER 20-06-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 18.01.2019 in connection with Bettiah(M) P.S. Case No.629 of 2018 registered for the offence under Section 392 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. and no incriminating article has been recovered from his conscious possession. It is further submitted that though the informant has given a detailed description and claims to have identified the culprit, the petitioner having been in jail for almost six months has not yet been placed on T.I. Parade. It is further submitted that the petitioner has been languishing in jail for no fault of his own

Patna High Court CR. MISC. No.37450 of 2019(2) dt.20-06-2019 2/2 and there is an unexplained delay of nine days in lodging of the present case.

Considering the aforementioned facts and circumstances and there being no recovery from his conscious possession, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bettiah, West Champaran, in connection with Bettiah (M) P.S. Case No.629 of 2018.
