JUSTICE SUDHIR SINGH ORAL ORDER 10-01-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are languishing in custody since 26.07.2016 in connection with Runnisaidpur P.S. Case No. 306 of 2016 for the offences instituted under Sections 379, 411 and 414 of the IPC.

The prosecution story, in brief, is that the petitioners took out cash, cheque book etc., from the dickey of the informant's motorcycle. He identified the accused in CCTV Camera. Subsequently, the accused were apprehended and the aforesaid articles were recovered from the dickey of the motorcycle of the accused persons.

No.53098 of 2016 (3) dt.10-01-2017 2/2 It has been submitted on behalf of the petitioners that the petitioners are in custody since 26.07.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioners. They have been made accused in the present case due to mistake of fact. On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi, in connection with Runnisaidpur P.S. Case No. 306 of 2016.
