The petitioner seeks bail in connection with Narpatganj (Ghurna) P. S. Case No. 366 of 2020 dated 18.08.2020, instituted for offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It appears that 827 litres of liquor was recovered from a vehicle which was being driven by the petitioner.

The learned counsel for the petitioner has submitted that he is the driver of one Rajendra Sharma,

Patna High Court CR. MISC. No.37722 of 2020(2) dt.05-02-2021 2/2 who is the owner of the vehicle, who too was sitting in the said vehicle. The petitioner had no idea that his owner was carrying liquor in the vehicle which was being driven by him.

The petitioner is in custody since 18.08.2020 with no criminal antecedents.

Considering the afore-stated facts, the petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-II cum Special Judge (Excise), Araria, in connection with Narpatganj (Ghurna) P. S. Case No. 366 of 2020. The petition stands allowed.
