2. Petitioner seeks bail who is in custody since 27.03.2026 in connection with Gadhaiya Bazar P.S. Case No. 81 of 2026 for the offences punishable under Section 191(2), 190, 191(3), 126(2), 115(2), 118(1), 109, 303(2), 352, 351(2) and 351(3) of BNS.

That the prosecution case in brief as stated by the informant namely Ranju Devi in his application is that when her husband regains consciousness then he told her that when he was returning from Chakiya on 25.03.2026 after taking light and Vegetables found bandh was broken and when he slow down his motorcycle then 8 to 9 person came start assaulting with Stick, Knife, weapon, iron Rod, Gun and used abusive language. Informant's husband falls down with motorcycle. And accused persons tied him with Towel. Occurrence tool place between Chakiya and Bhagarua Math near Transformer. Mainejar Kumar
2/4 Sahani attack with knife on head of Informant's husband due to which start bleeding from head. Meanwhile Dharmendra Kumar Sahani assaulted Informant's husband with iron rod sue to which head of Informant's husband has been teared and put gun on the temple of Informant's husband and said he will kill if he makes noise. Listening this Suresh Sahani took out the gun and point towards Informant's husband. After this Dinesh Kumar Choudhary Came and said kill him, he wants to become hero and hit the Informant's husband with knife on head which head start bleeding. Seeing this Hari Shankar Sahni and Ranjeer Sahani (Petitioner) both together took the golden chain from the neck of husband and start saying abusive word and also assaulted. Meanwhile Manager Kumar Sahani and Dharmendra Kumar Sahani took 25,000/- Rs.
from pocket of Informant's husband. Ravindra Sahani and Dinesh Kumar Choudhary took golden ring from finger of Informant's husband. All are Criminal Persons. When Informant's husband became unconsciousness then they think dead and leave him. When petitioner got consciousness then he found mobile in pocket from which he informed the family member. Family member and villager came and took him to Community Health Centre from there he was refer to Sadar Hospital Motihari.

4. Learned counsel for the petitioner submits that it appears from the FIR that informant is not an eye witness to the alleged occurrence although the petitioner is named in the FIR. It is next submitted that there is no specific allegation of assault or overt act against the petitioner rather the allegation against the petitioner is that petitioner along with co-accused persons have snatched the golden chain of the husband of the informant. Learned counsel for the petitioner next submits that the allegation is ornamental in nature and the police after investigation has submitted charge-sheet and that petitioner is in custody since 27.03.2026.
5. The learned Additional Public Prosecutor for State has vehemently opposed the prayer for bail of the petitioner and submits that husband of the informant have received injury and apart from aforesaid the petitioner has antecedent of one more case other than the present case.

Considering the aforesaid facts and circumstances , let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned JM, Sadar, East Champaran, Motihari or successor court in connection with
4/4 Gadhaiya Bazar P.S. Case No. 81 of 2026, subject to the following conditions:- i. Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below. ii. If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
iii. And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
