In this case, the petitioner is seeking anticipatory bail in connection with Mahua P.S. Case No. 23 of 2017, registered for the offence under Sections 188 and 276 of the Indian Penal Code and under Sections 18(c), 27(b)(ii) of the Drugs and Cosmetics (Amendment) Act.

Allegation has been made against the petitioner that he is running a Nursing Home and in that premise a Drug shop is also operating without any license.

Today, a supplementary affidavit has been filed, wherein it has been stated that the name of Medical shop is 'Pramod Medical Hall' and its proprietor's name is Pramod

Patna High Court CR. MISC. No.38906 of 2019(3) dt.03-07-2019 2/2 Kumar having a valid license, which has been attached to the supplementary affidavit.

In this view of the matter, let the above-named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Mahua P.S. Case no. 23 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Shivaji Pandey, J) pawan/- U T
