JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 26-05-2015 Petitioner apprehends arrest in Raj Nagar P.S. Case No. 154 of 2013 registered under sections 302, 201, 120(B) and 404 of the Indian Penal Code pending in the court of Chief Judicial Magistrate, Madhubani.

It is alleged that the victim and the petitioner had a partnership business. The victim had intended to withdraw himself from the partnership as a consequence whereof the petitioner was required to pay him Rs. 13.1/2 lakh. The victim wanted to partway with that money but the petitioner was not refunding that money. It is thus suspected by the informant who is the wife of the victim that it is the petitioner who might have killed her husband to escape with the liability of pay amount. Learned counsel for the petitioners states that

S far as the other accused persons are concerned, from their place certain recoveries were made but that does not connect the petitioner. Charge sheet in this case already been submitted. Considering the aforesaid facts, the above named petitioner in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Madhubani in Raj Nagar P.S. Case No. 154 of 2013, subject to the conditions as laid down under section 438(2) Cr.P.C.
