The petitioner seeks bail in a case instituted for the offence under Sections 414, 420, 467, 468/34 of Indian Penal Code.

As per written report, on confidential information police apprehended one motorcycle on which three persons were riding. Two persons were apprehended and one person managed to escape. Two persons namely, Anand Kumar Gupta and Barun Turha were apprehended and one apprehended person took the name of this petitioner. From impugned order of the learned 1st Addl. Sessions Judge, Bagaha, it appears that the motorcycle in

Patna High Court Cr.Misc. No.45814 of 2016 (5) dt.12-01-2017 2/2 question was seized from the house of the petitioner as mentioned in para-24, 25 and 26 of the case diary. The aforesaid fact was verified from para-24, 25 and 26 of the case diary and it was found that there is no any specific report that the stolen motorcycle has been recovered from the house of the petitioner. The petitioner is in custody since 20.06.2016.

Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate-II, West Champaran at Bagaha, in connection with Tr. No. 2273 of 2016 arising out of Bagaha P.S. Case No. 153 of 2014, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J.) ravi/- U T
