JUSTICE RAKESH KUMAR ORAL ORDER 18-10-2016 Heard Sri Ajay Kumar Pandey, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 26.07.2016 in Nautan P.S. Case No.100 of 2016 registered for the offence under Sections 341/323/504 of the Indian Penal Code and Sections 25(1-b)(a)/26 of the Arms Act, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that the present case was lodged by own father-in-law of the petitioner. He submits that the dispute arose in between the petitioner and his father-in-law regarding Vidagiri of his wife and in such dispute, falsely the petitioner was apprehended and produced before the police showing recovery of arms. Keeping in view the nature of accusation as well as period of custody, let the petitioner, namely, Rahul Mishra, be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Nautan P.S.
