====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 17-09-2018 Heard learned counsel for petitioner and learned counsel for the State.
Petitioner, who is in custody, seeks bail in connection with Surajgarha P.S. Case No. 82 of 2018 registered for the offences punishable under Sections 409/34 and 120(B) of the Indian Penal Code.
Allegation against the petitioner is of misappropriation and defalcation of government money after unauthorised withdrawal.
It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case due to mistake of fact. Petitioner has completed accounts of all Government money which have been spent and utilised under Government scheme. He has no criminal antecedent. He is in custody since 25.05.2018.
Considering the aforesaid fact and circumstances of
Patna High Court Cr.Misc. No.43960 of 2018(4) dt.17-09-2018 2/2 the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Surajgarha P.S. Case No. 82 of 2018.
