2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 30(a) and 30(d) of the Bihar Prohibition and Excise Act.
3. As per prosecution case, 45 litres country made liquor has been recovered near Dardha river.
4. Learned Counsel for the petitioner submits that no incriminating material has been recovered from the conscious possession of the petitioner. It is further submitted that the petitioner has been falsely implicated in this case merely on the basis of suspicion. Petitioner claims clean antecedent.
5. Learned APP for the State opposes the bail petition.
6. Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that
Patna High Court CR. MISC. No.50750 of 2025(3) dt.10-11-2025 2/2 let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, First Excise, Jehanabad in connection with Parasbigha P. S. Case No. 188 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
