JUSTICE RAKESH KUMAR ORAL ORDER 06-12-2016 Heard Sri Ajay Thakur, learned counsel, who was assisted by Sri Malay Kumar Choudhary, learned counsel for the petitioner and Sri Damodar Prasad Tiwary, learned Additional Public Prosecutor.
The petitioner , husband of the deceased has prayed for grant of bail in Hajipur Sadar P.S. Case No. 190 of 2015 registered for the offence under Section 304-B/ 498(A)/ 34 of the Indian Penal Code.
It was submitted by learned counsel for the petitioner that petitioner has falsely been implicated however on query he did not dispute that it was a case of strangulation and death had occurred in the house of the petitioner itself. Earlier in this case, case diary was called for which has
Patna High Court Cr.Misc. No.42100 of 2016 (3) dt.06-12-2016 2/2 been received and kept on record. Learned Additional Public Prosecutor after examining the case diary submits that there is sufficient material to show complicity of the petitioner. In view of the facts and circumstances I do not find any ground to grant bail.
The petition stands dismissed.
