Allegation against the petitioner is that the police intercepted the vehicle and arrested three accused persons, who stated that the Driver and Khalasi were in their captivity and considering the same, the prayer for bail of the petitioner was rejected, vide order dated 21.9.2017 passed in Cr. Misc. No.46592 of 2017.
Submission of the learned counsel for the petitioner is that he is in custody since 4.8.2016 and up-till-now the trial has not commenced and another co-accused having similar allegation has been granted privilege of bail, vide order dated 5.9.2018 passed in cr. Misc. No.38692 of 2018.
Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.40464 of 2018 (6) dt.03-10-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, since the petitioner is in custody, the learned trial court is directed to expedite the trial and try to conclude it expeditiously.
With the aforesaid observation, this application is dismissed.
