NILU AGRAWAL ORAL ORDER 27-07-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in jail since 09.04.2017 in a case registered for the offences punishable under Sections 379/411 of the Indian Penal Code.

The prosecution case as lodged by the informant is that his motorcycle, which was stolen on 24.12.2015 and while on 09.04.2017 he went for Vaishali Mahautsav, he found two persons riding his stolen motorcycle, who were apprehended and the petitioner was one of them.

It has been submitted by the learned counsel for the petitioner that he is innocent, has no criminal history and has been

Patna High Court Cr.Misc. No.27951 of 2017 (3) dt.27-07-2017 2/2 falsely implicated in this case. He submits that charge sheet has already been submitted, hence there is no chance of tampering with the prosecution evidence.

However, learned A.P.P. for the State opposes the prayer for bail.

Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- ( Rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Vaishali P.S.Case No. 89 of 2017, subject to the condition that one of the bailors would be a close relative of the petitioner.
