Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the I.P.C. The FIR would reveal that informant is not an eye witness of the occurrence of murder of her son rather allegation is there against the petitioner and three others to have committed murder by causing firearm injury. Some other witnesses only stated that the petitioner and others were found fleeing from place of occurrence. Petitioner has got no criminal antecedent. He is in custody since 30.04.2020. Investigation of the case is already complete.

Learned counsel for the informant opposed the prayer for bail.

Considering the fact that there is no direct material

Patna High Court CR. MISC. No.37141 of 2020(2) dt.02-02-2021 2/2 against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Khagaul Police Station Case No.93 of 2020 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
