JUSTICE MOHIT KUMAR SHAH ORAL ORDER 12-07-2018 The present writ petition has been filed seeking the following relief:- "That this writ application is being filed for issuance of writ/writs, direction/direction, command/commands to the respondent authority for making a direction and command the respondent specially the respondent nos. 2, 3 and 4 to grant pay protection to the petitioner in light of 5th Pay revision and 6th pay revision and further make a direction to respondent No. 5 to allow the corresponding scale in tune of Rs.

5,500/- to 49000/- and under 6th pay Commission recommendation in scale of Rs.

9300/- to Rs. 34800/- in place of 5200/- to 22,000/- be granted to the petitioner under equal pay for equal works at par to other Government employee working within the respondent No. 2 Collectoriat as Government servant.

Patna High Court CWJC No.20494 of 2010(2) dt.12-07-2018 2/2 Petitioner further prays for grant of identical and similar treatment with at par Government servant in relation to their pay petitioner further prays for a direction to respondent Nos. 2,3 and 4 and 5 to release the differential arrear of salary in view of different revised pay scale recommended by 5th pay Revision Commission and 6th pay Revision commission and after calculation grant regularly the recommended pay scale as per 5th and 6th pay commission be given to the petitioner."

The learned counsel for the petitioner has further filed I.A. No. 3300 of 2014 by which it has been prayed for release of the 3rd A.C.P. and pay protection.

In view of the nature of grievances raised by the petitioner, I direct the petitioner to file a detailed representation before the Respondent No. 2 / 3 for adjudicating the grievances of the petitioner and in case, such representation is filed, the Respondent No. 2 / 3 shall pass the final reasoned order within a period of six weeks from the filing of the said representation. The present writ petition is disposed of on the aforesaid terms.
