1. Heard learned counsel for petitioner and learned Additional Public Prosecutor.

2. Let the defect(s), if any, be removed within a period of four weeks from today.

3. This application is filed for grant of regular bail in connection with Simri (Dera O.P.) P.S. Case No. 60 of 2023 registered under section 395 of the Indian Penal Code.

4. Prosecution story in short is that one earing, cow, buffalo and its calf were taken away on gunpoint by the criminals from the informant.

5. The mobile of the informant has been recovered from the petitioner, The petitioner is accused in three similar cases. The learned counsel for the petitioner has submitted that a

Patna High Court CR. MISC. No.42584 of 2023(2) dt.14-07-2023 2/2 similar co-accused Phutali Nut has been granted bail by this Court in Cr.Misc. No. 34045/2023 from whom also looted buffalo has been recovered. He also submits that Phutali is also involved in six more cases. The petitioner is in custody since 24.03.2023.

6. Learned A.P.P. has vehemently opposed the prayer for bail.

7. Considering the period of custody, this application for regular bail is allowed.

8. Let the petitioner, above named, be released on bail after completion of nine months in custody and on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IVth at Buxar in connection with Simri (Dera O.P.) P.S. Case No. 60 of 2023.

9. The petitioner will visit Simri police station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
