The petitioner seeks a direction to the respondents for conducting examination and publishing their results of remaining semester of Primary Aryuvedic Kalpak Examination for academic session 1991-2001.

After delay of more than 10 years, filing of the present application belatedly without any valid reason disentitles the petitioner from invoking equitable remedy under Article 226 of the Constitution of India, which is a discretionary in nature and is available to only such persons who are vigilant about their rights.

Patna High Court CWJC No.511 of 2010 dt.27-03-2017 After nearly 17 years, no relief, as sought for by the petitioner, can be granted.

I do not consider it to be a fit case to be entertained. This application is, accordingly, dismissed on the ground of delay and laches.
