The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 387 and 34 of the Indian Penal Code. As per prosecution case, the allegation against the accused along with this petitioner is of threatening the informant and demanding extortion money from him.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case merely on the basis of suspicion. The petitioner is not named in the F.I.R. The allegation of threatening and demand of money from the informant is against the F.I.R. named accused Vikram Singh, not against this

During course of investigation the name of the petitioner has been transpired as an associate of the main accused Vikram Singh. It is also submitted that petitioner is languishing in judicial custody since 28.03.2023. Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Vijaypur (Bijaipur) P.S. Case No. 76 of 2023 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Gopalganj.
