Petitioner seeks bail in a case registered for the offences punishable under Sections 406, 420, 467, 468/34 of the Indian Penal Code.
Petitioner is not named in the F.I.R. The impugned order would reveal that bail was not granted to the petitioner only for the reason that case diary was not received by the court below. Apparently, there was no material before the court below to refuse the prayer for bail.
Learned counsel for the State opposed the prayer for bail and submitted that the petitioner has got criminal antecedent.

No.47044 of 2018(3) dt.16-08-2018 2/2 Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Aurangabad Town Police Station Case No.309 of 2009, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
