JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Gogari P.S. Case No. 08 of 2014 registered for the offences punishable under Sections 341, 342, 325, 307, 379,504/34 of the Indian Penal Code 27 of the Arms Act. Allegation against the petitioner is that he fired on the informant causing injury to him. Apart from that petitioner is accused in a number of cases.
Submission of the learned counsel for the petitioner is that after investigation police has not found case true against the petitioner but learned Magistrate has taken cognizance against the petitioner.
Heard learned A.P.P.also, who opposed the bail prayer submitted that petitioner has indulged in many criminal cases and informant in his restatement named the petitioner as
Patna High Court CR. MISC. No.42083 of 2019(3) dt.11-09-2019 2/2 assailant but instead of that police has submitted final form against the petitioner.
Having heard both sides, in view of the allegation as discussed above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned Court below and make prayer for regular bail which shall be considered on the basis of material available on record.
