This application for grant of anticipatory bail arises out of Goh P.S. Case No. 43 of 2014, disclosing offences under Sections 409 and 420 of the Indian Penal Code. The First Information Report has been instituted on the basis of written report of the Headmaster of Governmental Nationalized High School, Dadar, alleging that the petitioner, who was his predecessor, was not handing over the charge of the documents.
Learned counsel for the petitioner submits that no offence under the aforesaid Sections on the basis of allegation as contained in the First Information Report.
Patna High Court Cr.Misc. No.32406 of 2015 (2) dt.13-08-2015 2/2 Considering the aforesaid submission, this application is allowed.
Let the petitioner, above-named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Daudnagar, District-Aurangabad in connection with Goh P.S. Case No. 43 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
