JUSTICE SANJAY PRIYA ORAL ORDER 25-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Aurangabad Town P.S. Case No. 286 of 2009 instituted for the offence under Sections 341, 323, 506, 406 and 420/34 of the Indian Penal Code. Counsel for the petitioner submits that petitioner is not named in the written report. In the written report it is mentioned that accused No. 6 namely, Haribansh Narain Singh was the Executive Director of the Company.

In the written report it is alleged that informant has deposited Rs.10,000/- in OCPL Company under RMGP Plan for ten years, for which, he had been issued receipt, but Bond paper was not provided to him within 45 days. The informant went to the office of OCPL Company where he was manhandled and in

Patna High Court Cr.Misc. No.48716 of 2018 (3) dt.25-09-2018 2/2 connivance with other, all the accused persons as named in the written report have misappropriated the amount of Rs.20,000/-. In the written report there is no allegation of any overt act against the petitioner.

Petitioner is in custody since 22.05.2018.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad Town P.S.
