The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per the prosecution case, on information having been received about the involvement of the accused persons in the business of liquor, a raid was conducted and 42.375 litres of foreign liquor was recovered from the poultry farm of one Suresh Singh. It is stated that from the choukidar it transpired that the petitioner was also involved in the business. It is submitted by learned counsel for the petitioner that neither the petitioner was arrested at the spot nor any incriminating article has been recovered from his possession. He has no concern either with the seized liquor, the place of
Patna High Court CR. MISC. No.53814 of 2021(2) dt.01-04-2022 2/2 recovery nor with Suresh Singh. He is in custody since 22.6.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner not having any criminal antecedent and having remained in custody for more than 9 months, the Court directs the petitioner to be enlarged on bail in connection with Kudhani (Turki O.P) P.S. Case no. 195 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur.
