The petitioners apprehend their arrest in Complaint Case No. 294 of 2013, registered for the offences punishable under Section 384 and other Sections of the Indian Penal Code and Sections 3(i)(x) of the SC/ST Act.
The complainant alleged that lands of Khata No. 218 and 219 of Khesra No. 355, 356 and 357 are settled in the name of members of Scheduled Castes, but the petitioners and others put obstruction in cultivation of the land.
It is submitted that, of course, the settlement is made in favour of the complainant, but the petitioners are also claiming
Patna High Court Cr.Misc. No.44677 of 2014 (5) dt.22-06-2015 2/2 possession over the land.
There appears that on account of land dispute the case is filed, making allegation that the complainant was also abused. Considering the facts aforesaid, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in Complaint Case No. 294 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
