The petitioner apprehends his arrest in connection with Mohaniya P.S. Case no. 460 of 2016, registered under Sections 448, 323 and 354(B)/34 of the Indian Penal Code.
The accusation is that due to land dispute, this petitioner and one Rama Shankar Singh entered in the house of the informant Susila Devi and started abusing. On protest made by the informant, this petitioner assaulted on her back causing pain in her spinal code. On raising alarm, villagers came there then petitioner snatched golden chain from her neck.
Learned counsel for the petitioner submits that admittedly hot talks were exchanged in between the informant and the petitioner but due to ulterior motive petitioner has been implicated in this case with false allegation of assault to the informant. Moreover, no
Patna High Court Cr.Misc. No.53632 of 2016 (2) dt.19-12-2016 2/2 any injury found on the person of the informant. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Kaimur at Bhabua in connection with Mohaniya P.S. Case No.460 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
