JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 414,439 and 429 of the Indian Penal Code and Sections 11(d) and 11(3)(d) of The Prevention of Cruelty to Animals Act, 1960 though section 11(3) is not a penal provision.

It is alleged that 16 she-goats were recovered from the vehicle with nose and mouth tied with tape.

It is submitted by the learned counsel for the petitioner that petitioner is simply a driver of the vehicle in question and he was carrying animals on behalf of certain suppliers who escaped from the scene. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. More over, co accused Ajay Sharma who is owner of the vehicle has been

Patna High Court Cr.Misc. No.29828 of 2015 (2) dt.14-07-2015 2/2 granted anticipatory bail vide Cr. Misc. No. 11010 of 2015. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM, Saran at Chapra in connection with Dighwara P.S. Case No. 140 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
