JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-09-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the sister of the informant is languishing in custody since 21.6.2016 in a case registered under Sections 498A,313,384,323,504 and 379 of the Indian Penal Code.

The prosecution case is that the sister of the informant namely Bandana Devi was married with the petitioner on 3.12.1999 but thereafter torture was inflicted for non fulfillment of dowry demands and due to torture the pregnancy of the informant's sister got terminated.

It is submitted by the learned counsel for the petitioner that the petitioner admits his marriage with the sister of the

Patna High Court Cr.Misc. No.39923 of 2016 (2) dt.21-09-2016 2/2 informant and there is no proof with regard to termination of pregnancy. The sister of the informant has been very cruel to the petitioner as a result no child was born even after sixteen years of marriage.

It is submitted by learned counsel for the informant that the sister of the informant is still ready to resume the conjugal life. However, it is submitted that investigation has already concluded. In view of the fact that investigation has already concluded, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with Belsand P.S. Case No. 64 of 2012.
