The petitioner seeks bail in connection with Banka (Barahat) P.S. Case No. 538 of 2016 registered for the offences punishable under Section 366(A) of the Indian Penal Code. In the present case allegation has been made against the petitioner that he has kidnapped the victim girl namely Priyanka Kumari, aged about 15 year.

It has been submitted on behalf of the petitioner that the girl in her statement recorded under Section 164 of the Cr.P.C., has stated her age about 17 years and further stated that she had gone with the petitioner at her own sweet will. The petitioner incarcerating in jail custody since

Learned A.P.P.

opposes the prayer of bail application.

Having heard both sides, in view of the fact that the victim girl does not support the prosecution version in her statement recorded under Section 164 Cr.P.C., and as per her statement her age is about 17 years, and inasmuch as the chargesheet has been submitted. Let the petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Banka (Barahat) P.S. Case No. 538 of 2016.
