Petitioners, already in custody, seek bail in G.R.P.S. Gaya Case No.5 of 2017 registered under Section 413/34 of the Indian Penal Code and 8, 20 (B) (ii) (B) of N.D.P.S. Act. Allegation in brief is that the petitioners were carrying bag containing 6 kg. of ganja in the train and apprehended by the G.R.P.

Learned counsel appearing on behalf of the petitioners submits that petitioners were travelling in the train along with other passengers and a bag was kept nearby and it was not theirs so the recovery is not from their conscious possession. Moreover, the quantity of ganja is not commercial and the petitioners have clean antecedent and are in custody since 6.1.2017.
