2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 316 ( 2 ), 318 ( 4 ), 109, 352, and 3 (5) of BNS.

3 . As per the prosecution case , the marriage of daughter of informant was fixed with co-accused Chandra Prakash @ Ajjet Kumar Mishra an out of total dowry amount of Rs. 21 lacs, informant transferred Rs. 7 lacs on different dates in the bank account of parents of the petitioner and 11 lakhs in cash . It is further alleged that due to demand of a four wheeler, the marriage negotiation failed and petitioner side returned Rs. 7

Patna High Court CR. MISC. No.39088 of 2025(3) dt.26-09-2025 2/3 lacs but kept Rs. 11 lacs with dishonest intention .

It is submitted on behalf of the petitioners that petitioners are innocent and have falsely been implicated in this case with ulterior motive to compel the son of petitioners (coaccused Chandra Prakash @ Ajjet Kumar Mishra) to perform marriage with daughter of informant. Petitioners have already returned the alleged amount of Rs. 7 lacs to the informant which was transferred in their account. Petitioners claim clean antecedent. Co-accused Chandra Prakash @ Ajjet Kumar Mishra (son of both the petitioners) has already been granted bail by this Hon'ble Court vide order dated 02.09.2025 in Cr. Misc. No. 41166 of 2025 .

5 . Learned counsel for the State oppose the bail petition .

6 Considering the fact that petitioners have already refunded the alleged amount of Rs. 7 lacs to the informant, backdrop of the case and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Begusarai in connection with
