JUSTICE SUDHIR SINGH ORAL ORDER 29-07-2015 The petitioner is apprehending her arrest in connection with Phenhera P.S. Case No. 36 of 2014 for the offences instituted under Section 304(B)/34 of the IPC.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that the informant got her daughter married in the year 2012 with Shibu Lal, who always tortured her for dowry. She alleges that all the accused persons killed her daughter and were in full preparation of disposing the dead body but she reached on information and informed the police who sent the dead body for post-mortem.

It has been submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.29778 of 2015 (2) dt.29-07-2015 2/2 petitioner has got no criminal antecedent. It is further stated that the petitioner is said to be the Gotani of the deceased. She is separate in mess and property from the husband of the deceased. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of her arrest or surrender before the learned court below within a period of six weeks from today in connection with Phenhera P.S. Case No. 36 of 2014(G.R. No. 994/2014) on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sikarahana at Motihari, East Champaran, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
