JUSTICE ARUN KUMAR ORAL ORDER 13-06-2017 Heard learned counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Mohania P.S. Case No.331 of 2013 registered under Sections 457 and 380 of the Indian Penal Code.

Allegation in brief is that a cartoon containing large numbers of mobile phones worth of Rs.2,41,720/- was stolen from the house of the informant.

Learned counsel appearing on behalf of the petitioner submits that mere suspicion was raised against the petitioner as he was a labourer in the house of the informant. The F.I.R. was lodged after lapse of three days. Nothing has been recovered from possession of the petitioner. Moreover, the impugned order passed by the learned Sessions Judge shows that only suspicion was

Patna High Court Cr.Misc. No.22788 of 2017 (2) dt.13-06-2017 2/2 raised and he has been in custody in this case without any cogent evidence and has got no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Yogendra Yadav @ Jogendra Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Kaimur at Bhabua in connection with Mohania P.S. Case No.331 of 2013.
