The petitioner seeks bail in connection with Garkha P.S. Case No. 114 of 2023 registered for the offence under Sections 399, 402, 324, 307, 332, 353, 34 of the Indian Penal Code and Section 25(1-B)a, 26, 27, 35 of the Arms Act. The petitioner and other co-accused persons are said to have fired upon the police in which one police personnel sustained gun shot injury.

It has been submitted by the learned counsel for the petitioner that the petitioner is the elder brother of Rejesh Kushwaha @ Rajesh Singh who has criminal antecedents and it is his friends who had fired upon the police and thereafter, they fled way. The petitioner has been arrested by the police because

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the above, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail after completing six months in custody, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Saran at Chapra in connection with Garkha P.S. Case No. 114 of 2023.
