JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-05-2021 Heard Mr. Rajesh Kumar, learned counsel for the petitioners and learned APP for the State. The petitioners seek bail in anticipation of their arrest in connection with Piparahi P. S. Case No. 108 of 2020, dated 11.06.2020, instituted for the offences under Sections 323, 324, 341, 379, 308, 504 and 506 of the Indian Penal Code.
Though all the petitioners have been named in
Patna High Court CR. MISC. No.39171 of 2020(2) dt.03-05-2021 2/3 the F.I.R., but so far as the specific accusation of assault by dagger is concerned, it is on Ranju Sahani and not the petitioners. The petitioner nos. 1 and 2 are said to have dragged the victim by tying Gamchha round his neck whereas the petitioner no. 5 is said to have stolen away one locket from the possession of the informant. The injuries suffered by the informant is said to be simple in nature.
The petitioners have clean antecedents and because of land dispute, the present case has been filed. It has also been submitted that though the occurrence took place on 05.06.2020 but after six days, i.e., on 11.06.2020, the subject F.I.R. has been lodged. Considering the afore-stated facts, the petitioners, above-named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten
Patna High Court CR. MISC. No.39171 of 2020(2) dt.03-05-2021 3/3 Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheohar, in connection with Piparahi P. S. Case No. 108 of 2020, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
The application stands allowed.
