JUSTICE SUDHIR SINGH ORAL ORDER 14-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 457 and 380 of the I.P.C. The prosecution story, in brief, is that on the alleged date and time of occurrence some unknown thieves entered in the office and residential room of the informant and committed theft of Samsung mobile and cash Rs.8000/- from the pocket, wrist watch, shoes, sandle, L.C.D., cash Rs.12500/- from Daraz, cash Rs.60,000/- from almirah and other things.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 19.8.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of
Patna High Court Cr.Misc. No.52616 of 2016 (2) dt.14-12-2016 2/2 witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. He has been made accused merely on the basis of suspicion. The petitioner has not been put on T.I.P. to ascertain his implication in the present case.
On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Kumar Amit Manu, learned Additional Chief Judicial Magistrate-2, Araria in connection with Jokihat P.S. case No.252 of 2016.
