The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 452, 341, 323, 380, 427, 353, 504 and 506 of the Indian Penal Code.
It is alleged that the informant being the village Chowkidar along with police officials came to the house of Bindhyanand Mahto for identification and identified the Bindhyanand Mahto. Then 50-60 unknown persons came variously armed to the house of the informant, threw the house hold articles and took away Rs. 10,000/- and destroyed the house hold articles.
Patna High Court Cr.Misc. No.30150 of 2015 (2) dt.29-07-2015 It is submitted by the learned counsel for the petitioners that only to terrorize the petitioners the present case has been lodged. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent and accusation against the petitioners is omnibus and general. Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Motihari in connection with Patahi P.S. Case No. 56 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
